On the 10th April, a Polish Air Force Tupolev 154, crashed on approach to Smolensk, Russia, killing President Lech Kaczynski, his wife and 94 others. Their state funeral, on the 18th was missing many world leaders, who were forced to cancel because of the volcanic ash cloud that had enveloped Europe and closed most of its airports. An Icelandic volcano meant President Barack Obama, Prince Charles, President Nicolas Sarkozy and Chancellor Angela Merkel, among others, could not attend the funeral of the crash that had probably put airlines on high-alert. The airline industry has lost over €2bn in the past week, but it is failing for many other reasons. Monty Python seemed to have nailed the futility of positive thinking. Oprah Winfrey, self-help books and pop-psychologists have convinced us that all rejections, disasters or setbacks are actually invitations to ‘move on’, that problems are merely opportunities for self-improvement and that negativity is inherently a bad thing. So it is good to read a book that confirms this bombardment of positivism is actually as counter-intuitive as it feels. Barbara Ehrenreich has written a book called Smile or Die: How positive thinking fooled America and the World, which, as it turns out, is extremely affirming in its view of negativity. Ehrenreich does not approach her critique of life coaches and motivational speakers flippantly, but from her own experience of misery and dejection. Mainz: Gerade in Krisenzeiten mit knappen Personalbeständen sind längere Arbeitszeiten an der Tagesordnung. Aber sind das auch „Überstunden“? Als "Überstunde" ist nur die Arbeitszeit zu verstehen, die über die durch Einzelvertrag, Tarifvertrag oder Betriebsvereinbarung bestimmte regelmäßige Arbeitszeit hinausgeht, so die Definition des deutschen Anwaltsvereines (DAV). Nach einer Erhebung des Deutschen Gewerkschaftsbundes tun dies junge Angestellte wöchentlich mit durchschnittlich 5,3 Stunden. Wichtig: "Die Arbeitszeit kann über mehrere Wochen oder Monate hinweg unterschiedlich verteilt sein", erläutert Joachim Vetter, Vorsitzender Richter am Landesarbeitsgericht Nürnberg. "Nur wenn die werktägliche Arbeitszeit im Durchschnitt, innerhalb eines Ausgleichszeitraumes von sechs Kalendermonaten oder 24 Wochen, mehr als acht Stunden beträgt, gilt die regelmäßige Arbeitszeit als überschritten", so der DAV. Und nur dann sei das Mehr an Arbeit auch "Mehrarbeit - also eine Überstunde im rechtlichen Sinn. Wer also zeitweise länger arbeitet, dafür zu anderer Zeit aber entsprechend weniger zu tun bekommt, leistet keine Überstunden.
